BOOKING TERMS & CONDITIONS FOR ELEPHANT WATCH SAFARIS LTD

1) Making a Booking

To make a booking at Elephant Watch Camp or to book a bespoke safari, please email us at info@elephantwatchsafari.com

To book Olerai House (B&B), The Dairy, The Studio, or Tinga House (self-catering) email info@siroccowild.com

Provisional bookings will be held on request for 14 days from the date of enquiry.

We offer a certain amount of flexibility to extend provisional bookings where possible.

Reservations are confirmed upon receipt of a 30% non-refundable deposit.

Please note that until a non-refundable deposit is received, Elephant Watch Safaris Ltd has every right to release a booking.

By confirming a booking with Elephant Watch Safaris Ltd., the Agent takes full responsibility for the booking, financial or otherwise, on the guests behalf, and confirms that the information provided to the guest and to Elephant Watch Safaris is true, accurate and complete.

Required information for all bookings made:

  • The dates and duration of stay, plus arrival and departure travel details
  • Full names, dates of birth, passport details, and nationalities of guests
  • Rooming requirements - double, single, twin, triple or family room
  • Any medical conditions, special dietary needs, or special requests
  • Proof of status for Kenya Residents/Citizens

2) Payment

Full and final payment must be received by Elephant Watch Safaris Ltd no later than forty-five (45) days prior to arrival. If final payment is not received by this time, the booking may be released without notice. Payments must be made in the currency specified in the invoice and excludes financial transaction fees.

3) Cancellation

Postponements, changes, amendments and cancellations are only effective on receipt of written notification.

Confirmed bookings that are canceled >45 days prior to the date of arrival, forfeit the 30% non-refundable deposit.

Confirmed bookings that are canceled <45 days prior to the date of arrival, forfeit 100% of payments received.

Separate terms may govern all third-party reservations such as hotels or other safari lodges that we book on your behalf and this will be communicated to you.

4) Children

Our lodges are child-friendly and welcome families of all kinds. Child rates apply as follows:

  • Children aged 2 years and under stay for free (gratis)
  • Elephant Watch Camp - 3 to 15 years old (under 16)
  • Olerai House - 3 to 12 years (under 13)

5) Wild Animals

Safaris in Africa entail a certain degree of risk. We advise our guests to consult their guide before undertaking any activity that may bring them into an area populated by wild animals.

Attacks by wild animals are rare, but no safari into the African wilderness can guarantee that this will not occur.

Neither the company, nor its employees, owners or agents can be held responsible for any incident or injury on safari that may or may not result in loss of possessions or death.

6) Rates

Rates may be subject to change due to sudden currency fluctuations, tax increases, governmental regime change etc.. Elephant Watch Safaris Ltd will strive to adhere to published rates but reserves the right to adjust them as needed.

7) Requirements on final bookings

Guests should be aware that they need to sign indemnity forms at check-in or before hand. If guests decline to sign these forms then, unfortunately, they will not be allowed to take part in certain activities such as game drives, bush walks, dinners, sundowners, or specialized elephant encounters.

8) Check in

Guests can check in to their room/tent from 11.00 a.m. Check out is at 10.00 a.m. sharp. Early check-in and late check-out can be accommodated on request, subject to availability.

For guests departing in the afternoon, a surcharge may apply for meals and activities until their afternoon departure.

Late departures MUST be pre-booked and are subject to the availability of a vehicle and space at the location to cater for extra guests.

9) Insurance

It is a condition of using the rates and services offered by the Company that all clients (including individuals, companies, and other legal entities) take out appropriate comprehensive medical insurance (including cover for pandemic related occurrences), emergency medical evacuation, travel and other insurances prior to departure of the clients from their country of origin.

This insurance should include, but be not limited to, the following eventualities: any expenses associated with cancellation or curtailment of a reservation held, emergency evacuation and medical expenses, personal injury or death, repatriation expenses, damage/theft/loss of personal property, baggage, money, or goods.

Insurance should be arranged from the time a deposit is made to cover cancellation from that time onward.

The Agent hereby agrees to indemnify the property from loss, liability, damage, or any cost that may be incurred arising from the failure of the Agent to inform the guests of the need to obtain travel and medical insurance.

A visit to Africa and particularly a safari entails an element of risk and neither the Company nor its officers and employees shall be liable in any way for any loss or damages expense or cost arising from any incident involving clients (individuals, companies, and other legal entities) that may occur whilst using any of the services provided by the Company or third parties contracted by this company.

Attendance of safety briefings are mandatory.

10) Law

It is a condition of making a reservation with the Company that the client agrees that these terms and conditions constitute a contract under Kenyan Law and the client agrees irrevocably to the exclusive jurisdiction of the Kenyan Courts and that in the event of any dispute or action of any kind against the Company that dispute, or action shall be heard under Kenyan Law in the Kenyan Courts.
